'Voluntary' deportation practice scrutinized by immigrants

Immigrants in the Chicago area may feel pressure regarding their legal status every day. Making one wrong move could lead to deportation hearings, which puts a tremendous strain on families. Until individuals can obtain legal status and overcome immigration status issues, this concern doesn't go away.

When deportation hearings are started, it may be difficult for individuals to understand exactly what options they have. If they don't properly handle their hearing, then they may be unfairly sent away from their friends and family. Right now, however, a group of seven immigrants is moving forward with a lawsuit that puts the practice of "voluntary departure" in the spotlight.

According to the legal claim filed by the American Civil Liberties Union on behalf of the seven people, U.S. immigration officials regularly misconstrue the legal options available to undocumented immigrants facing the threat of deportation. Through this process, people may wind up forgoing a hearing by waiving their rights, which will almost certainly result in deportation.

The lawsuit claims that these immigration practices are a violation of due process rights, which help to ensure consistency and fairness in legal proceedings. The immigration system is immensely complex, and trying to navigate legal proceedings with the fear of deportation and misinformation looming overhead only makes the immigration process more convoluted.

When facing deportation, a person can consult with an immigration attorney to determine their rights and options in order to avoid being split up from their loved ones in the United States. This way, a person may have a better chance to move down the path toward an adjustment of status, which simplifies many aspects of life.
